☷US Department of Labor seeks court order to stop alleged retaliation by Tennessee farm after employee finds severed pig s head at workstation

The US Department of Labor is going to court to try and stop a Tennessee farm from getting back at two employees who asked about their pay , which is protected by the Fair Labor Standards Act . The department filed a complaint and motion on Feb . 21 , 2024 , asking the court to make Tosh Pork LLC and their human resources manager , Dianna Rosa , stop retaliating against workers . It ' s against the law for employers to fire or discriminate against workers who file complaints or cooperate with investigations . The department ' s Wage and Hour Division found that two workers at Tosh Pork cooperated with investigators after asking about their pay . In response , the employer made one worker do extra cleaning duties and accused them of filing a complaint . They also tried to make the worker sign a document saying they wouldn ' t talk about pay with other employees . Another worker who asked about their wages was threatened with termination and later found a severed pig ' s head at their workstation . The Department of Labor is determined to protect workers and will use all available resources to do so . The investigation also revealed that Tosh Pork didn ' t meet employment requirements for H - 2A visa workers and owed back wages to five workers . The department has also fined them . Workers should feel safe reporting concerns to the Department of Labor without fear of retaliation . Tosh Pork hires foreign workers through the H - 2A agricultural guest worker program . The company has 11 , 000 acres of land where they raise pigs and grow various crops like corn , soybeans , and wheat . Tosh Pork LLC sells its products to big companies like JBS USA , Kroger , and Costco for distribution across the country and internationally .
