Hey , guess what? The Department of Labor just recovered $196K after finding out that owners and managers of Subway restaurants in Washington were keeping the tips . And get this , the franchise owners also have to pay $22 , 017 for intentional violations . The employers involved are Jani Enterprises Inc . , Keeyarah Enterprises Inc . , Kian Enterprises Inc . , and Quantum Enterprises USA Inc . The investigation found that 10 Subway restaurants allowed the owners and managers to take part in the employees ' tip funds , which is totally against the Fair Labor Standards Act . This meant that 100 restaurant employees in Arlington , Des Moines , Kent , Lake Stevens , Marysville , Monroe , and Sultan didn ' t receive the tips left by customers on their credit card payments . On top of that , the employer tried to avoid paying overtime by manually changing the employees ' hours worked to make it look like they worked less than 40 hours a week , and they didn ' t add up the hours worked at multiple locations . But here ' s the good news: they managed to recover $80 , 528 in tips and $17 , 546 in overtime pay for those 100 employees . And as a bonus , they also got $98 , 074 in damages for those employees . Oh , and don ' t forget the $22 , 017 in fines for the intentional violations . According to Thomas Silva , the district director of the Wage and Hour Division in Seattle , these Subway owners and managers intentionally violated the Fair Labor Standards Act by underpaying employees and keeping tips that weren ' t theirs . They ' re recommending that employers review their practices to avoid the costly consequences of illegal practices .
