The US Department of Labor has recovered $119 , 000 in unpaid wages and damages for 43 workers who were denied overtime by H . K . Construction , a construction employer in Hawaii . The company has been assessed $14 , 526 in penalties . H . K . Construction , which provides residential construction services on Oahu , was found to have disregarded the Fair Labor Standards Act and underpaid its field employees . They failed to pay overtime rates and tried to substitute the cost of tools for wages . They also did not record and pay hours worked by office employees and misclassified workers as exempt from overtime pay . The workers have been paid $59 , 679 in back wages and $59 , 679 in liquidated damages , while the company has been fined $14 , 526 . District Director Terence Trotter in Honolulu said that employers must pay wages correctly and on time and that this case should serve as a reminder to all employers . Workers can check if they are owed back wages using the division ' s Workers Owed Wages search tool , and both employers and workers can seek help from the Wage and Hour Division . The department ' s Timesheet App can also help ensure accurate recording of hours worked and pay .
