The U . S . Department of Education’s Office for Civil Rights ( OCR ) announced today that the San Francisco Conservatory of Music has made an agreement to comply with Title IX when dealing with accusations of student - to - student sexual harassment , including sexual assault and stalking . OCR investigated a complaint from a student who said she was sexually assaulted and stalked by another student in 2022 . The investigation found that the Conservatory did not respond properly under Title IX guidelines . They failed to provide the student with necessary support , resulting in her losing access to certain classes and activities during the investigation . The Conservatory also failed to follow proper procedures in the investigation phase , such as providing written notice and offering both parties the chance to review evidence . They also did not hold a live hearing . At the determination stage , the Conservatory failed to address the allegations and notify the student of her right to appeal . In the resolution stage , OCR found the Conservatory ' s responses to reports of the respondent violating an order and stalking the student to be unreasonable . The Conservatory ' s Title IX grievance procedures were also found to be non - compliant with regulations , and they did not fulfill their recordkeeping obligations . The resolution agreement requires the Conservatory to take steps to ensure gender equality in all of its programs and activities . Catherine E . Lhamon , Assistant Secretary for Civil Rights , stated that the agreement will ensure the Conservatory complies with Title IX to protect all students in the future . The Conservatory has agreed to do the following as part of the resolution agreement: They will review and update their policies to comply with Title IX regulations , provide training and guidance to staff members involved in responding to sexual harassment reports , share information with OCR about all complaints of sexual harassment , take measures to ensure the safety of students on campus , offer reimbursement for health - related costs , provide copies of the investigative report to the student and the respondent , and allow the student to retake any affected class for free . You can find the resolution letter and agreement on the Office for Civil Rights website .
