☷US Department of Labor obtains judgment requiring defunct Westmoreland County company president to restore $40K to its health plan

The US Department of Labor recently got a judgment that requires a company in Westmoreland County and its president to repay $40 , 000 to its health plan . This action was taken on Feb . 8 , 2024 , after a motion for default judgment was issued by the US District Court for the Western District of Pennsylvania . The company , Ken - Co Fabricating Co . Inc . , and its president , Robert Kendi , were found to have violated the Employee Retirement Income Security Act of 1974 by failing to make premium payments for coverage while still deducting premiums from plan beneficiaries . As a result , they have been ordered to repay the unpaid medical claims and have been removed as fiduciaries of the plan . An independent fiduciary will now oversee the plan ' s management and administration . Regional Solicitor of Labor Jeffrey Rogoff emphasized the importance of fiduciaries carrying out their duties for the benefit of plan participants , and EBSA Regional Director Cristina O ' Brien noted that the court ' s judgment will help those affected by the violations .
