The US Department of Labor has recovered $26 , 927 in unpaid wages and damages for 36 employees of a fast - food franchise in Alabama . The franchise allowed its managers to illegally deduct time worked , resulting in violations of minimum wage and overtime laws . The Department of Labor found that the franchise knowingly engaged in these violations by clocking out employees while they continued working , deducting break time from schedules regardless of whether breaks were taken , deleting portions of shifts from pay records , and altering timecards to reduce hours and avoid paying overtime . This is not the first time the franchise has been found in violation of wage laws , as similar violations were discovered at its other locations in 2020 . In addition to the monetary recovery , the franchise was also assessed civil money penalties for the repeated nature of its violations . The Department of Labor emphasized the importance of protecting workers and law - abiding employers from such illegal actions . Furthermore , the franchise was found to have violated child labor regulations by employing underage workers for longer hours than allowed by law . Civil money penalties were also assessed for these violations . The Department of Labor stressed the need to ensure that young workers ' first jobs are safe and do not interfere with their education or well - being . The YouthRules! initiative is all about making sure young workers have a positive and safe experience at work . They provide information to teens , parents , employers , and educators about the rights and protections for young workers . The U . S . Department of Labor and its partners are all about helping young workers get ready for the workforce through this initiative . The Wage and Hour Division also has some helpful tips for employers on how to follow the child labor laws . The people who run Checkerboard Montgomery LLC and Checkerboard Montgomery 2 LLC also own four other Checkers and Rally ' s restaurants in Alabama , Georgia , and North Carolina . If you have any questions or concerns , you can call the Wage and Hour Division confidentially at 1 - 866 - 4 - US - WAGE ( 487 - 9243 ) . You can also learn more about the division and find out if you ' re owed any back wages by using their search tool . And if you work in a restaurant , they have information about your rights under the FLSA . Both workers and employers can keep track of their hours and pay by downloading the department ' s Timesheet App for free on Android or iOS , in English or Spanish .
