The US Department of Labor has recovered $180K for 22 workers who were denied overtime pay by a restaurant employer in Sacramento . Taquería Los Inmortales , the employer , also had to pay $7 , 980 in fines . An investigation by the Department of Labor ' s Wage and Hour Division found that the employer , who owns three Taquería Los Inmortales restaurants in Sacramento under three different entities , did not pay employees overtime for hours worked over 40 hours in a workweek , in violation of the Fair Labor Standards Act . The employer paid overtime at regular hourly rates , in cash , and did not keep accurate records . The recovered amounts include $90 , 383 in unpaid overtime wages and an equal amount in damages for 22 employees . The employer also paid $7 , 980 in civil monetary penalties for intentional violations . In response to this case , Cesar Avila , the district director of the Wage and Hour Division , stated , "Restaurant workers are often some of the lowest earners in our communities and deserve to take home every dollar they earn . The US Department of Labor wants to help restaurant employers and workers understand their obligations and rights under the law . We offer free compliance assistance tools and other resources to prevent costly violations like those found in this case .
