In Albuquerque , New Mexico , Jimmy Roberts Guillen made an appearance in federal court on charges of attempted arson and arson . Guillen , 59 , will remain in temporary custody until a detention hearing . The indictment states that on September 3 , 2023 , Guillen tried to set fire to the Lowe ' s store and also caused damage to the Walmart store , both located in Clovis , New Mexico . It ' s important to note that an indictment is just an accusation and the defendant is considered innocent until proven guilty . If found guilty , Guillen could face up to 20 years in prison . The Bureau of Alcohol , Tobacco , Firearms and Explosives led the investigation with assistance from various law enforcement agencies , including the Clovis Police Department , Roosevelt County Sheriff ' s Office , and others . Assistant U . S . Attorney Maria Elena Stiteler is handling the prosecution .
