POSITION SUMMARY
This position provides legal representation for the County, its County Board, agents, boards, committees, and departments as described under Wisconsin State Statute §59.42 under the direction of the County Administrator and jurisdiction of the Administration Committee. This position represents and advises County leadership in civil matters, responds to legal inquiries, rendering legal assistance and opinions, litigating cases, and drafting policies, procedures, ordinances, contracts and legal documents.
ESSENTIAL FUNCTIONS
The following duties are typical for this position. However, these are not to be construed as exclusive or all-inclusive. To perform this job successfully, an individual must be able to perform each duty satisfactorily. Other duties may be required and assigned.
Organizes and directs the day-to-day operations of the Office.
Develops and recommends the annual budget for the Corporation Counsel’s Office to the County Administrator; forecasts necessary funding for staff, equipment, material, and capital improvement plans. Monitors budget throughout the year.
Serves as general legal counsel and represents the County in Court in civil and administrative proceedings.
Conducts legal research; drafts and issues legal opinions.
Drafts, reviews, and researches County resolutions, ordinances, contracts, and legal documents.
Attends County Board meetings and provides legal consultation to the County Board and its duly constituted agencies, boards, commissions and committees; elected officials, county departments and county employees. Attends meetings of boards, commissions and committees upon request or direction from the County Administrator.
Serves as Parliamentarian for the County Board of Supervisors which includes interpretation and explanation of Robert’s Rules of Order and County Board Rules and Procedures.
Reviews claims, suits, and demands and recommends disposition. Coordinates discovery with county departments, develops litigation strategy and negotiates/analyzes settlement proposals.
Advises all departments, agencies, committees, boards and commissions on the Wisconsin Open Meetings Law and Public Records Law and provides legal guidance and assistance to records custodians responding to public records requests. Responds to open records requests and advises other departments on open records requests.
Provides legal representation of the County or State regarding any civil litigation defense of behalf of Burnett County and acts as liaison between the county and any outside counsel in any civil litigation defense; and Wis Stat. Chapters 51, 54, 55, 48, 938, and 767.
Represents the County in real estate transactions; drafts and reviews various real estate documents.
Provides case management for the County by drafting petitions, citations, complaints, orders, resolutions, briefs, opinion letters, ordinances, contracts, deeds, judgments, easements and other legal documents as required.
Represents and advises the Child Support Agency and provides statutory and contractual legal representation for child support and paternity cases by attending agency meetings, drafting, reviewing and approving documents and appearing at hearings.
Advises and represents the Health and Community Services Department in guardianship and protective placement proceedings, children in need of protection and services (CHIPS) proceedings (CHIPS) & Juvenile in Need of Protection or Services (JIPS) and termination of parental rights (TPR) proceedings.
Prosecutes County ordinances which are not based on criminal state statutes, generally involving zoning, sanitation, animal control and truancy.
Engages with committees, members of the public, the County Board, the judiciary, the District Attorney’s office, the Public Defender’s office, and the various County departments regarding the formulation of policies, ordinances, local court rules, and reform efforts.
