☷Final Rule to Update Regulations for Older Americans Act Programs

Originally published as an HHS press release , the rule that was released today by ACL updates regulations for implementing its Older Americans Act ( OAA ) programs . This is the first major update to the regulations since 1988 and it aims to support the national aging network and improve program implementation . The goal is to ensure that older adults can receive the services they need to live independently in their own homes and communities . HHS Secretary Xavier Becerra stated that older Americans should be able to age with dignity and this update strengthens the system of supports that help them do so . Alison Barkoff , who leads the Administration for Community Living , mentioned that the majority of Americans want to age in their own homes and the programs and services provided through the Older Americans Act make this possible . The updated regulations reinforce policies and expectations , provide guidance for programs , and incorporate lessons learned from the COVID - 19 pandemic . State agencies need to have flexible and streamlined processes in place for area agencies on aging to get approval for contracts and commercial relationships . The new rules also provide guidance for the National Family Caregiver Support Program and the Native American Caregiver Support Program . It addresses emergency preparedness and response , taking into account what we ' ve learned from the COVID - 19 pandemic . The rules also set expectations for legal assistance and preventing elder abuse . It clarifies the role of the aging network in protecting against guardianship and promoting alternatives . The rules also update definitions , requirements , and flexibilities within the OAA nutrition programs . For example , it allows for carry - out meals in certain situations . These rules are the result of collaboration with the national aging network and input from various organizations . They will take effect in March 2024 , but entities have until October 2025 to comply . We will provide resources and assistance to help everyone comply with the new regulations .
