Turns out they were misclassified as independent contractors by this security services company called Prior Vision LLC in Hawaii . The company didn ' t pay them for working more than 40 hours a week , which is a big no - no according to the Fair Labor Standards Act . The investigators found that these so - called independent contractors were actually dependent on Prior Vision , not running their own businesses . The company also didn ' t keep proper records of hours worked and wages paid . So , the employees are getting back $65 , 642 in back wages , another $65 , 642 in damages , and the company has to pay $36 , 000 in penalties for being reckless . District Director Terence Trotter in Honolulu said employers can ' t just ignore a worker ' s right to overtime pay . Misclassifying employees to avoid paying them fairly is totally illegal . The Department of Labor has announced a new rule to help employers and workers understand the difference between employees and independent contractors . They want to tackle the issue of employee misclassification , which is a serious problem affecting workers ' rights and the economy .
