The Department of Education ' s Office for Civil Rights ( OCR ) dropped some new resources today with info for students , parents , and schools on the civil rights of students with disabilities . They also shared a data snapshot on education access for students with disabilities from their 2020 - 21 Civil Rights Data Collection ( CRDC ) . These resources aim to educate students with disabilities , along with their families and schools , about their rights under Section 504 of the Rehabilitation Act of 1973 . OCR wants to make sure students with disabilities , like those with asthma , diabetes , food allergies , and GERD , know their rights under federal disability laws . The data snapshot shows that 8 . 4 million students with disabilities made up 17% of public school enrollment in the 2020 - 21 school year . The new resources focus on common medical conditions that could be considered disabilities under Section 504 , like asthma , diabetes , food allergies , and GERD , and explain how these conditions can trigger protections under the law . OCR also highlighted disparities in the educational experiences of students with disabilities , including higher rates of restraint and seclusion , disproportionate disciplinary actions , and underrepresentation in advanced programs .
