NIST recently released a draft guidance for public feedback on when federal agencies should consider requiring licensing of patents developed with government funding . The guidance aims to help agencies make decisions on march - in rights , including factors like pricing . The Bayh - Dole Act allows recipients of federal research funding to retain rights to inventions , but federal agencies can step in under specific circumstances . The government is seeking input on this draft guidance to clarify march - in rights and strike a balance between innovation and serving the public .
