Mayor Kraham Appoints Phil Strawn Following 6
thDistrict "Failure To Elect"

Mayor Jared M . Kraham issued the following statement:
"On Thursday , I appointed Phil Strawn to the 6
thDistrict City Council seat , following the tie vote that resulted in a "failure to elect" this past election . He was sworn in at the Broome County Clerk ' s Office on Thursday afternoon .
Councilman Strawn served residents well during his previous four years on City Council and will continue to bring a problem - solving approach and spirit of working together to the body in this temporary role .
This appointment ensures a continuity of constituent services and representation for 6
thDistrict residents until a special election can be held in November for the remainder of the term .
Over the last several weeks , the incoming Council members and my office worked through legal questions of an unprecedented tie vote . The City ' s Office of Corporation Counsel , general counsel for the New York Conference of Mayors and outside counsel for the City found the appointment authority in this "failure to elect" situation rests with Binghamton ' s mayor under state law .
This appointment fulfills that legal obligation .
Any attempt by City Council to make a subsequent appointment goes against the legal advice of Corporation Counsel , general counsel for the New York Conference of Mayors and outside counsel for the City . An unlawful appointment could lead to a costly legal dispute , which is not in the interest of taxpayers . "
