☷HHS Announces Proposed Regulation to Strengthen Services and Protections for Unaccompanied Children in Its Care

Today , the U . S . Department of Health and Human Services , specifically the Administration for Children and Families’ ( ACF ) Office of Refugee Resettlement , announced a new rule for the care of unaccompanied children . This rule would establish clear standards for their well - being and safety while in the custody of ORR . The rule includes provisions for placement , release , emergency operations , transportation , and monitoring . It also expands access to legal services , child advocates , post - release services , and language assistance . Procedural protections and independent oversight mechanisms will be put in place to ensure due process . An Office of the Ombuds will be created to address concerns and provide oversight . The proposed rule has been developed after consulting with various stakeholders and will be open for public comment for 60 days . Any expansions of services will depend on Congressional appropriations . “ORR is legally required to provide care for all unaccompanied children referred to the Center until they can be appropriately and safely released to a vetted sponsor . We take that directive very seriously , " said ORR Director Robin Dunn Marcos . “The proposed rules we are announcing today will protect the children we serve , especially in terms of quality care , due process protection , language access , post - release services , and supervision . It codifies and expands on the important steps we have taken . ' ' # ## .
