St . Charles County goes to court , defending the right of Missouri counties to collect sales tax on recreational marijuana sales .
Moving to intervene in a lawsuit filed against St . Louis County by the marijuana industry , St . Charles County is asserting that counties have a legal right to collect a sales tax on recreational marijuana sales—even if there is also a local town sales tax on marijuana .
In April 2023 , St . Charles County voters enacted a 3% tax on recreational marijuana sales county - wide .
Opponents claim it’s unconstitutional to have overlapping sales taxes for marijuana .
But St . Charles County’s attorneys say the language in the constitutional amendment allows a county - wide tax on the products .
“…the governing body of any local government is authorized to impose , by ordinance or order , an additional sales tax in an amount not to exceed three percent on all tangible personal property retail sales of adult use marijuana sold in such
political subdivision
. ”

A Florissant - based marijuana dispensary filed suit in early October , challenging St . Louis County’s 3% sales tax on marijuana . The suit claims counties can’t collect a sales tax on marijuana on top of city taxes .
“We’re intervening in this St . Louis County suit because we think the marijuana industry is trying to twist the language and prevent a tax that the law allows , ” says St . Charles County Executive Steve Ehlmann .
Ehlmann notes that St . Charles County voters approved the county - wide tax by a 72% vote .
In St . Charles County , there are 13 marijuana dispensaries in operation , with the potential for generating an estimated $800 , 000 in tax revenue annually for the County .
